Pregnancy Leave Laws
Under California and federal law, leaves of absence
related to pregnancy are protected. Under the U.S. Pregnancy Discrimination Act
("PDA"), it is illegal to discriminate against a pregnant woman or woman with
related conditions. The California Pregnancy Disability Leave Law ("PDLL")
provides up to 4 months of leave to be taken all at once or as needed for a
pregnancy, childbirth and related conditions. As with the California Family
Rights Act ("CFRA") and Family and Medical Leave Act ("FMLA"), an employee may
not be fired or discriminated against for taking such leave. An employee who
takes pregnancy leave under this law may take as addition 12 workweeks off for
child care leave under the California Family Rights Act.
